Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MedHub Kenya (“MedHub,” “we,” “us,” or “our”), including the MedHub mobile application, website, and related services (collectively, the “Service”).

By creating an account, accessing, or using MedHub, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with these Terms, you must not use the Service.

1. About MedHub Kenya

MedHub Kenya is an educational platform designed to support medical education, examination preparation, revision, practice, and academic development.

MedHub may provide features including:

• Medical examination questions and practice materials
• Revision and examination modes
• Subject-based learning
• Performance tracking and analytics
• Academic rankings and achievements
• Study notes and learning resources
• AI-assisted educational tools
• Challenges and other learning or community features
• Offline access to supported content
• Account synchronization and related services
• Subscription-based premium features

Features may vary by application version, account status, subscription status, device, region, or availability.

2. Definitions

For these Terms:

• “App” means the MedHub Kenya mobile application.
• “Service” means the App, MedHub website, backend services, content, features, and other services provided by MedHub Kenya.
• “User,” “you,” or “your” means any person accessing or using MedHub.
• “Account” means the registered MedHub account associated with a user.
• “Subscription” means a paid plan that provides access to designated premium features or content for a specified period.
• “Content” means questions, explanations, notes, images, graphics, text, resources, software, educational materials, and other material made available through MedHub.

3. Eligibility

MedHub is primarily intended for medical students, healthcare learners, healthcare professionals, educators, and other individuals using the Service for legitimate educational purposes.

You must provide information that is reasonably accurate when creating an account.

If you are under the age required to independently enter into an agreement under applicable law, you must have the necessary permission or consent from your parent or legal guardian to use the Service.

You are responsible for ensuring that your use of MedHub complies with the laws applicable to you.

4. Creating and Maintaining an Account

Certain MedHub features require an account.

When creating an account, you agree to:

• Provide accurate information.
• Keep your account information reasonably up to date.
• Protect your login credentials.
• Not share your account in a manner that circumvents access restrictions.
• Notify MedHub if you reasonably believe your account has been compromised.
• Accept responsibility for activity conducted through your account, except where such activity results from circumstances for which you are not reasonably responsible.

You must not create accounts for fraudulent, abusive, or deceptive purposes.

5. Educational Purpose

MedHub is an educational and examination-preparation platform.

MedHub does not replace:

• Medical school teaching
• Lecturers or instructors
• Official academic curricula
• University examinations
• Professional medical training
• Clinical supervision
• Qualified medical professionals
• Official medical guidelines or regulatory requirements

Information provided through MedHub should not be relied upon as a substitute for professional medical advice, diagnosis, treatment, or clinical judgment.

If you are making an actual clinical decision concerning a patient, you should rely on appropriate qualified professionals, authoritative clinical resources, institutional protocols, and applicable guidelines.

6. Educational Content

MedHub provides educational content intended to support learning and examination preparation.

We make reasonable efforts to maintain useful and accurate educational material. However, medical knowledge changes, errors may occur, and educational questions or explanations may contain inaccuracies, omissions, or outdated information.

You should use appropriate academic and authoritative sources when verifying information.

MedHub does not guarantee that:

• Every question is error-free.
• Every explanation is complete.
• Content reflects the most recent medical guidelines.
• Content exactly matches your institution's curriculum.
• Your examination will contain questions similar to those presented in MedHub.
• Use of MedHub will result in a particular academic grade or examination outcome.

7. AI-Assisted Features

MedHub may provide artificial intelligence (“AI”) features intended to assist learning.

AI-generated responses may include explanations, summaries, examples, study assistance, or other educational material.

AI output may be incomplete, inaccurate, outdated, or unsuitable for a particular academic or clinical context.

AI features should therefore be treated as educational assistance rather than authoritative medical information.

You remain responsible for independently evaluating important information and verifying medical or academic claims using appropriate authoritative sources.

MedHub does not represent that AI-generated information is always accurate or appropriate for clinical decision-making.

8. Questions, Examinations and Performance Results

MedHub may provide practice questions, examinations, revision sessions, rankings, performance ratings, achievements, statistics, and other academic measurements.

These features are intended to help users understand and monitor their learning progress.

Scores, rankings, performance ratings, difficulty assessments, and related calculations may be affected by:

• Question updates
• Changes to scoring systems
• Algorithm improvements
• Corrections to content
• Changes in available questions
• Changes in user participation
• System updates

Accordingly, historical scores or rankings may change where reasonably necessary to maintain accuracy or improve the Service.

MedHub does not guarantee that its performance measurements correspond exactly to a user's performance in an external university or professional examination.

9. Offline Functionality

MedHub may provide functionality that allows certain content and features to operate without an internet connection.

Offline availability may vary depending on the feature and application version.

When using MedHub offline:

• Some features may be unavailable.
• New content may not be immediately available.
• Changes made on another device may not appear immediately.
• Results or other information may remain locally stored until synchronization occurs.
• Synchronization may require an internet connection.

You are responsible for maintaining sufficient storage space on your device and using a supported version of the App.

MedHub cannot guarantee that locally stored data will remain available indefinitely in every circumstance, including device failure, application corruption, operating-system changes, or unauthorized deletion of local data.

10. Subscriptions

MedHub may offer free and paid access levels.

Paid features are provided through subscriptions offered within the Service or through authorized MedHub subscription channels.

Subscription prices, duration, included features, and availability will be displayed before you subscribe.

Prices may be presented in Kenyan Shillings (KES) or another currency where applicable.

A subscription grants you a limited, personal, non-transferable right to access the features included in that subscription during the applicable subscription period.

A subscription does not transfer ownership of MedHub software, content, or intellectual property to you.

11. Subscription Activation and Verification

MedHub may use third-party services to facilitate subscription purchases and verify subscription status.

Your subscription may require successful confirmation of the relevant transaction before premium access is activated.

MedHub may temporarily restrict premium features where a subscription cannot be verified, has expired, has been reversed, or has otherwise become invalid.

You must not attempt to manipulate, forge, reproduce, modify, or circumvent subscription verification.

12. Subscription Cancellation and Expiry

You may cancel your subscription according to the cancellation process applicable to the subscription channel through which you subscribed.

Cancellation does not necessarily result in immediate termination of access. Unless otherwise stated, access may continue until the end of the applicable paid subscription period.

When a subscription expires or is cancelled, premium features may become unavailable.

Your account itself will not necessarily be deleted merely because your subscription expires.

13. Subscription Changes

MedHub may introduce new subscription plans, modify existing plans, change included features, or change subscription prices.

Where required by applicable law, reasonable notice will be provided before material changes affecting an existing subscription take effect.

Changes will not automatically invalidate rights that have already been paid for unless permitted by applicable law or agreed with you.

14. Free Trials and Promotional Access

MedHub may occasionally offer a free trial or promotional access.

Where offered, the eligibility conditions will be displayed at the time of participation.

Unless otherwise stated:

• A promotional trial is intended for one legitimate user.
• Attempts to repeatedly obtain promotional access through multiple accounts, installations, manipulated application state, device information, system time, or other mechanisms may result in the promotional access being withdrawn.
• MedHub may restrict promotional access where reasonably necessary to prevent abuse.

MedHub may change, suspend, or discontinue promotional programs subject to applicable law.

15. Refunds

Subscription refunds are handled in accordance with the applicable subscription channel, applicable law, and any refund terms presented at the time of purchase.

Nothing in these Terms is intended to exclude or restrict any consumer rights or statutory rights that cannot lawfully be excluded.

16. Referral and Promotional Programs

MedHub may operate referral, ambassador, campus-agent, promotional, or similar programs.

Participation may be subject to additional terms and eligibility requirements.

You must not:

• Create fraudulent referrals.
• Refer yourself through artificial means.
• Create accounts solely to generate rewards.
• Misrepresent MedHub.
• Make unauthorized promises concerning MedHub.
• Manipulate subscription or referral systems.

MedHub may investigate suspicious activity and withhold, reverse, or cancel rewards associated with invalid or fraudulent activity.

17. User Content

Certain MedHub features may allow users to create, store, or share content such as notes, comments, study material, challenges, or other information (“User Content”).

You retain ownership of User Content that you legally own.

By submitting User Content to a feature that requires MedHub to store, process, display, or distribute that content, you grant MedHub the limited rights reasonably necessary to operate that feature.

You represent that you have the necessary rights to submit the User Content and that your content does not unlawfully infringe another person's rights.

You must not upload or share content that is unlawful, abusive, defamatory, fraudulent, malicious, or intended to compromise the security of the Service.

MedHub may remove User Content that violates these Terms or applicable law.

18. Acceptable Use

You agree to use MedHub responsibly and lawfully.

You must not:

• Attempt to gain unauthorized access to MedHub systems.
• Circumvent authentication or access controls.
• Bypass subscription restrictions.
• Manipulate examination or scoring systems.
• Manipulate system time or application state to obtain unauthorized benefits.
• Reverse engineer or decompile the App except where expressly permitted by applicable law.
• Modify the App for unauthorized purposes.
• Introduce malware, malicious code, or harmful software.
• Scrape or systematically extract MedHub content without authorization.
• Use automated systems to abuse the Service.
• Reproduce or redistribute substantial portions of MedHub's question bank or proprietary content.
• Impersonate MedHub or another user.
• Use MedHub to facilitate unlawful activity.
• Interfere with the availability or operation of the Service.
• Attempt to obtain another user's account or private information.

19. Security and Fraud Prevention

MedHub may implement technical and organizational measures designed to protect accounts, prevent abuse, detect fraudulent activity, and maintain the integrity of the Service.

These measures may include detection of unusual activity, account security events, application integrity issues, abnormal usage patterns, and attempts to circumvent access restrictions.

MedHub may restrict, suspend, or terminate access where there is reasonable evidence of serious abuse, fraud, unauthorized access, or deliberate circumvention of security controls, subject to applicable law.

Security measures may evolve as threats and technologies change.

20. Intellectual Property

MedHub and its licensors retain all rights, title, and interest in the Service and its proprietary materials.

This includes, where applicable:

• Software
• Branding
• Logos
• User interface designs
• Question banks
• Original explanations
• Graphics
• Databases
• Algorithms
• Performance systems
• Written material
• Audio or visual material
• Other proprietary content

Except where expressly permitted, you may not reproduce, redistribute, commercially exploit, sell, sublicense, publicly republish, or create derivative works from MedHub's proprietary content.

Your subscription provides access to the Service; it does not transfer ownership of MedHub intellectual property.

21. Copyright and Third-Party Rights

MedHub respects intellectual property rights.

If you believe that material available through MedHub infringes your rights, you may contact MedHub using the contact information provided below with sufficient information to identify the material and explain the basis of the claim.

Users must not knowingly submit content that infringes another person's intellectual property rights.

22. Third-Party Services

MedHub may depend on third-party services for functions such as:

• Hosting
• Data storage
• Authentication
• Subscription processing
• Analytics
• Notifications
• Infrastructure
• Application distribution
• AI services
• Other technical functionality

Third-party services may have their own terms and privacy policies.

MedHub is not responsible for independent failures, outages, policies, or actions of third-party services beyond MedHub's reasonable control.

23. Privacy and Data Protection

Your use of MedHub is also governed by the MedHub Kenya Privacy Policy.

The Privacy Policy explains how MedHub collects, uses, stores, protects, and deletes personal information.

By using MedHub, you acknowledge that you have been provided access to the Privacy Policy.

Where applicable, MedHub will process personal information in accordance with applicable data-protection laws.

24. Account Deletion

You may request deletion of your MedHub account through the account-deletion mechanism provided by MedHub.

When an account is deleted, MedHub will delete associated personal information in accordance with its Privacy Policy and applicable law.

Certain information may be retained where retention is legally required or reasonably necessary for legitimate purposes such as fraud prevention, security, dispute resolution, accounting, or compliance with legal obligations.

Deleting an account may permanently remove access to associated account information, progress, and other synchronized data.

25. Suspension and Termination

You may stop using MedHub at any time.

MedHub may suspend or terminate an account or restrict access to particular features where reasonably necessary because of:

• Violation of these Terms
• Fraudulent activity
• Unauthorized access
• Abuse of the Service
• Circumvention of subscription or trial restrictions
• Security threats
• Illegal activity
• Conduct that materially harms MedHub or other users

Where appropriate and reasonably practicable, MedHub may provide notice or an opportunity to address the issue before termination.

Termination does not remove obligations or rights that by their nature should survive termination.

26. Changes to the Service

MedHub is continuously developed and may change over time.

We may:

• Add features.
• Modify features.
• Improve algorithms.
• Correct errors.
• Update educational content.
• Remove obsolete features.
• Change the user interface.
• Introduce new services.
• Discontinue features where reasonably necessary.

We do not guarantee that every feature will remain available indefinitely.

Where a change materially affects an existing paid service, MedHub will take reasonable steps required by applicable law.

27. Application Updates

You may be required to install application updates to continue using certain features.

Updates may include:

• Security fixes
• Bug fixes
• New features
• Performance improvements
• Content updates
• Compatibility changes

Using an outdated version may result in reduced functionality or incompatibility with some MedHub services.

28. Service Availability

MedHub aims to provide reliable service but does not guarantee uninterrupted availability.

Service interruptions may occur because of:

• Maintenance
• Network failures
• Server or infrastructure failures
• Software errors
• Security incidents
• Internet-service disruptions
• Third-party outages
• Device or operating-system problems
• Events outside our reasonable control

We may temporarily restrict access when necessary to protect users, data, infrastructure, or the integrity of the Service.

29. Disclaimer of Warranties

To the maximum extent permitted by applicable law, MedHub is provided on an “as is” and “as available” basis.

We do not guarantee that:

• The Service will always be available.
• The App will operate without errors.
• Educational content will always be accurate or current.
• AI-generated content will always be correct.
• The Service will satisfy every user's educational requirements.
• Your examination performance will improve as a result of using MedHub.
• Offline functionality will work under every device or operating-system condition.
• Data will never be lost or corrupted.

Nothing in these Terms excludes a warranty or legal right that cannot lawfully be excluded.

30. Limitation of Liability

To the maximum extent permitted by applicable law, MedHub Kenya and its operators will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from your use of the Service.

This includes, where legally permissible, losses arising from:

• Loss of data
• Loss of academic opportunity
• Loss of profits
• Service interruption
• Device failure
• Reliance on educational information
• Third-party service failures

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

31. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or reasonable expenses arising from your unlawful use of MedHub, your violation of these Terms, or your infringement of another person's rights.

This provision does not apply to the extent that the relevant loss resulted from MedHub's own unlawful conduct or liability that cannot legally be excluded.

32. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Kenya, subject to any mandatory rights or protections that apply to you under applicable law.

Where a dispute arises concerning the Service, the parties should first attempt to resolve the matter through good-faith communication.

Nothing in this section prevents a user from exercising any statutory rights available to them.

33. Changes to These Terms

MedHub may update these Terms when reasonably necessary, including when:

• The Service changes.
• New features are introduced.
• Legal requirements change.
• Security practices change.
• Subscription arrangements change.

The updated Terms will be made available through MedHub and/or the MedHub website.

The “Last Updated” date indicates when the Terms were most recently revised.

Where required by applicable law, material changes will be communicated to users through an appropriate notice.

34. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally possible.

The remaining provisions will continue to apply.

35. Entire Agreement

These Terms, together with the MedHub Kenya Privacy Policy and any additional terms expressly applicable to particular MedHub features or programs, constitute the agreement governing your use of the Service.

If there is a conflict between these Terms and a specific feature's additional terms, the additional terms will apply to that feature to the extent of the conflict.

37. Acceptance
